Oregon Medical Marijuana Laws

oregon-medical-marijuanaCannabis for medical use in Oregon was approved via Ballot Measure 67 by 55% of voters on Nov. 3, 1998, finally becoming effective on December 3, 1998

The law removes state-level criminal penalties on the use, possession and cultivation of marijuana by patients who possess a signed recommendation from their physician stating that marijuana “may mitigate” his or her debilitating symptoms.

House Bill 3052, which became effective on July 21, 1999 issued the following directive:

Patients (or their caregivers) may only cultivate marijuana in one location, and requires that patients must be diagnosed by their physicians at least 12 months prior to an arrest in order to present an “affirmative defense.” This bill also states that law enforcement officials who seize marijuana from a patient pending trial do not have to keep those plants alive.

There have been numerous updates and amendments, however you will find the most up to date information Oregon Administrative Rules, Division 8, Medical Marijuana. This document is dated December 15, 2009.

Conditions Approved for Use of Medical Marijuana in Oregon

  • Cancer
  • Glaucoma
  • Agitation due to Alzheimer’s disease
  • Positive status for human immunodeficiency virus or acquired immune deficiency syndrome, or treatment for these conditions;
  • A medical condition or treatment for a medical condition that produces, for a specific patient, one or more of the following:

(i) Cachexia
(ii) Severe pain
(iii) Severe nausea
(iv) Seizures, including but not limited to seizures caused by epilepsy; or
(v) Persistent muscle spasms, including but not limited to spasms caused by multiple sclerosis

  • Any other medical condition or treatment for a medical condition adopted by the Department

Cannabis Quantities Allowed

  • A patient or the patient’s designated primary caregiver may possess up to six mature marijuana plants, 24 ounces of usable marijuana, and a patient and the patient’s designated primary caregiver may possess a combined total of up to 18 marijuana seedlings or starts.
  • A grower may produce marijuana for and provide marijuana to a patient or that person’s designated primary caregiver and may possess up to six mature plants and up to 24 ounces of usable marijuana for each patient or caregiver for whom marijuana is being produced;
  • A grower may also possess up to 18 marijuana seedlings or starts for each patient for whom marijuana is being produced;
  • A grower may produce marijuana for no more than four patients or designated primary caregivers concurrently.
  • A patient, the designated primary caregiver for a patient and the grower must have, in his or her possession, his or her OMMP identity card when transporting marijuana. A patient must have, in his or her possession, his or her OMMP identity card when using marijuana in a location other than the residence of the cardholder.

  2. Hi ive been getting migraines and I have had 2 skull fractures and me and my mom have gone to my doctor and he has given me several types of medication to treat it and none of them seem to work. I have been too young in the past too be able too use marijuana. I am 14 years old and my mother says its okay if I were to get a medical cannabis card. But I was curious if I am the legal age to apply?

  3. I have had asthma since I was born and have been on several different medication. The problem I have had is I don’t qualify for state medical assistance and being unemployed I can’t afford doctors or perscriptions. I have been taking expired medication to prevent my attacks because I can’t afford anything else however I have read from different site and studies that asthma has been treated with edibles and vaporiser. I was wondering if the state of oregon recongizes this as a symtom qualifible for oregon requierments?

  4. I’ve had asthma my whole life and i’ve tried numerous types of medication. No matter what I try, there always seems to be a negative effect. For the past 3 years, every time i’ve use my inhaler, i’ve gotten sick to the stomach and have found myself laying in bed for an hour or so before the pains were gone.

    I was looking into medicinal marijuana, when a friend of mine mentioned that THC naturally opens up your lungs, allowing for more air flow. It felt strange that marijuana could help with my asthma since it’s smoke and you would think smoke would effect my asthma in a negative way. I found out that the only side effect is the tar, but other than that, there were no other negative effects.

    When i said i’ve tried numerous asthma medications, that consisted of inhalers, humidifiers and pills. The only semi-effective treatment was the humidifier, but it took forever for it to kick in and it always made my room humid and made it hard for my to fall asleep. The pills that were supposed to block serious asthma attacks only made me sick and lowered my appetite.

    As i was reading the information, it mentioned nothing about marijuana helping asthma or other respiratory illnesses, so i curious, is it possible to get a medicinal card for asthma?

  5. yes i have some real bad pain in my elbow from a couple of surgeries that wont go away with pills so i just dont get them, i also have bad back pains that my doctor cant figure out y i get them so i was woundering if i could get my medical marijuana card for them or how hard it would be to get it?

Ending the insanity of drug prohibition by legalized regulation, respecting the rights of the responsible users and focusing on addiction as a sickness, like we do with alcohol and tobacco, may save what remains of our economy and civil institutions along with countless lives and livelihoods. We’ll need to make sure that such a catastrophe is never ever repeated. This may mean that public hearings or tribunals will be held where those who’ve been the instigators and cheerleaders of this abomination will have to answer for their serious crimes against our once prosperous and proud nation.

    Each day you remain silent, you help to destroy the Constitution, fill the prisons with our children, and empower terrorists and criminals worldwide while wasting hundreds of billions of your own tax dollars. Prohibition bears many strong and startling similarities to Torquemada­’s inquisition­, it’s supporters are servants of tyranny and hate. If you’re aware of but not enraged by it’s shear waste and cruel atrocities then both your heart and soul must surely be dead.

  11. hello i am someone with back pain,and i’ve been dealing with pain since i was hit from behide and fractured my vetabreue metal was put in and pain was still there!they went in again and no go pain got worse they wanted to try again and i said no.They gave pain pills and that caused other probleums and personality change,anyway i want to know what to do cause it helps deal with the pain and all other probleums go away. i want to do this right.It helps ,need advice!

    In oregon if I live there how do the caregivers paid for by a governement program, get compensated for the work or?
