Marijuana Related Penalties in Kentucky

  • Possession of less than eight ounces of marijuana is a misdemeanor
  • First offense: up to one year in jail and a fine of up to $500
  • Subsequent offenses: 1 to 5 years in jail and a fine of $1,000 – $10,000
  • Possession of 8oz or more: classed as possession with intent to sell and charged as for trafficking

Trafficking Offenses

  • Sale or delivery of less than 8oz: up to one year in jail and a fine of up to $500
  • Sale or delivery of 8oz or more: 1 to 5 years in prison and a fine of $1,000 – $10,000
  • Sale or delivery of 5lbs or more: 5 to 10 years in prison and a fine of $1,000 – $10,000

Sales involving Minors

  • First offense involving any sale to a minor: 5 to 10 years in prison and a fine of $1,000 – $10,000
  • Subsequent offenses involving any sale to a minor: 10 to 20 years in prison and a fine of $1,000 – $10,000
  • Any sale within 1,000 yards of a school: 1 to 5 years in prison and a fine of $1,000 – $10,000


  • First offense of cultivating less than five plants: up to one year in jail and a fine of up to $500.
  • Subsequent offenses of cultivating less than five plants: 1 – 5 years in prison and a fine of $1,000 – $10,000
  • First offense of cultivating five plants or more: 1 to 5 years in prison and a fine of $1,000 – $10,000
  • Subsequent offenses for cultivating five or more plants: 5 to 10 years in prison and fines of $1,000 – $10,000

Possession of Paraphernalia

  • First offense of possession of marijuana related paraphernalia: up to one year in jail and a fine of up to $500
  • Subsequent offenses of possession of marijuana related paraphernalia: 1 to 5 years in prison and a fine of $1,000 – $10,000

Offenses by Minors

Minors convicted of drug offenses are also subject to suspension of their driver’s licenses for one year for the first offense and two years for the second offense.

The Future of Medical Marijuana in Kentucky

I can find no real activity in Kentucky to forward the case for use of medical cannabis within the state. There is no
chapter and the Kentucky Medical Marijuana Society seems to consist of, at most, two activists, although the blog has six followers. (My apologies to that organization if I have underestimated – if you feel this is the case, let us – and everybody who follows this site – know!)



  1. Mark l Jan.27 Kentucky made a 2 new bills sb57 medical marijuana they are already selling license to start dispensary and sb72 legalize for adult use I don’t no if this one will pass yet but sb57 will if they are already selling license.

  2. I have heard that Kentucky honors the federal cards not sure of the difference but I have from a good source that his wife transferred her card from oregon to kentucky any info on that if not ill look into it further.

  3. Lol…I am the co-administrator of the “Kentucky Medical Marijuana Society”….and yes it is pretty much a dormant site. It was handed to me a number of years ago and I took it because at that time I wasn’t trying to keep up that many blogs.

    Since then I have been VP of the US Marijuana Party up until August of 2011. At that time I went independent to I also maintain a number of other blogs.

    Since I receive no donations or funding of any kind the website has been slow coming along. But it has some very good pertinent information for Kentucky and I encourage everyone to see it and really look thru the information there.

    Right now I’m trying to watch SB129 to see where it’s going to go.

    I received a letter from Sen. Mitch McConnell which is posted on the above site. To no surprise he is adamantly opposed to it.
    We can expect Beshear to be a NO vote too. It would surprise me if we get anything from him.

    But God Bless the two Senator’s from Kentucky (D) Sen. Perry Clark (Jefferson County) and (D) Sen. Kathy Stein (Fayette County) for introducing and supporting this bill.

    The truth is out there and persistent. The ONLY reason the government of ANY state would not pass a law like this is a conspiracy that I believe even goes even further than the MONEY. If it were just the MONEY you would think that they would approve the Bill so as to MAKE some MONEY….

  4. I believe our first effort should be to organize. There seems to be no organized intelligent effort under way to bring the marijuana issue to the politicians. Lobbying is the way!!

  5. I think it’s really sad that ky would refuse to see the good in marijuana.

    I have Schizoaffective disorder and have been symptom free for 6 months because pot can calm me enough to keep the symptoms away. I think when a medicine can be the difference between living a normal life and being locked in a mental ward for ever, people should reconsider.

  6. I had a stroke in April 2010 a by-pass in Aug and a pace maker put in in Oct.

    With the Dr screwing up my nerves in my right leg pain 24-7 and Ky tells my no way it’s not gonna happen so guess time to move out of this old man state it should be legal in couple years after all these old ass plititians die.

  7. The laws are so strict in ky even teenagers are getting drug tested at their own public high schools
